Terms of Use and Subscription Terms
MovingSteady | Version 1.0 | Effective October 3rd 2026
1. Acceptance of Terms
These Terms of Use and Subscription Terms (“Terms”) govern access to and use of MovingSteady, including movingsteady.com, customer accounts, participant access links, exercise videos, weekly exercise selections, support-profile features, communications, and related services (collectively, the “Service”).
By creating an account, purchasing a subscription, accessing paid content, or otherwise using the Service after being presented with these Terms, the user agrees to be bound by them.
2. About MovingSteady
MovingSteady is a general wellness and at-home exercise service designed primarily for older adults. The Service provides prerecorded exercise and movement content and may organize or suggest content based on user-selected preferences or capabilities.
MovingSteady is not a healthcare provider and does not provide medical care, physical therapy, occupational therapy, diagnosis, treatment, rehabilitation, or emergency services.
3. Eligibility and Account Responsibility
Users must be at least 18 years of age and have legal capacity to enter into these Terms.
The person who creates an account is responsible for maintaining the confidentiality of account credentials and for activity occurring through the account, except to the extent caused by MovingSteady or its service providers.
An account owner may purchase the Service for another adult participant. Account ownership does not, by itself, give the account owner authority to make healthcare decisions for the participant, waive the participant’s legal rights, or accept the Participant Waiver on the participant’s behalf unless the account owner has lawful authority to do so.
4. Participant Access and Support Profiles
The Service may allow an account to include a participant profile and a family or support profile. These profiles may be available under the same account login, depending on the subscription plan.
A support profile may display general activity information such as workouts completed, minutes of movement, weekly streak information, exercise focus selections, or similar non-clinical information. These features are intended to support encouragement and engagement and are not medical monitoring.
Where MovingSteady provides a participant with a unique or time-limited access link, the user is responsible for not knowingly sharing that link with unauthorized people.
5. Exercise Content and User Responsibility
Exercise content is provided for general informational and wellness purposes. Users are responsible for determining whether they can safely participate and for following applicable safety instructions. Users should review the separate Health and Exercise Disclaimer and Participant Waiver made available with the Service.
MovingSteady may add, remove, replace, or modify exercises, video content, weekly selections, focus categories, features, or program structure over time.
6. Subscriptions and Billing
Certain features of the Service require a paid subscription. Available plans, prices, billing intervals, included features, and any introductory or promotional terms will be displayed at checkout.
Unless otherwise stated at checkout, subscriptions automatically renew for the same billing interval until canceled. The payment method on file may be charged for each renewal at the then-current price, subject to applicable law and any required advance notice of price changes.
Payments may be processed by a third-party payment provider, such as Stripe. MovingSteady does not necessarily receive or store complete payment-card information.
Minnesota Automatic Renewal Disclosures (pursuant to Minn. Stat. § 325G.57):
- Offer Terms: Before you accept the offer, the subscription terms are presented in a clear and conspicuous manner. - Confirmation: After you accept, MovingSteady will provide a confirmation capable of being retained that includes the offer terms and cancellation instructions. - Cancellation: You may terminate this agreement at any time. Instructions are provided in your account confirmation. - Annual Reminder: For continuous service subscriptions, MovingSteady will provide written notice at least once per calendar year including the terms of service and how to terminate or manage the service. - Material Changes: MovingSteady will provide clear and conspicuous notice of any material change prior to implementation, along with termination information. - Free Trials: If a free trial exceeds 30 days, MovingSteady will notify you 5–30 days before trial expiration of your option to cancel. - No Unsolicited Retention Offers: During cancellation, MovingSteady will not offer discounts or incentives unless you affirmatively consent to receive them.
7. Cancellation
A subscriber may cancel a subscription through the cancellation method made available in the account or through another method required by applicable law. If you entered into the subscription online, a simple online cancellation mechanism is available in your account.
Cancellation stops future renewals but does not automatically entitle the subscriber to a refund for a billing period already paid, except where required by law or under a refund policy expressly offered by MovingSteady.
Access may continue through the end of the paid billing period unless otherwise stated at the time of cancellation.
8. Refunds
MovingSteady does not provide refunds for billing periods already paid, except where required by applicable law. This includes partial billing periods.
You may cancel your subscription at any time in accordance with Section 7 (Cancellation). Cancellation will stop future renewals but will not retroactively refund payments already made, except where required by law or under a refund policy expressly offered by MovingSteady.
If MovingSteady terminates your subscription without cause, or if applicable law requires a refund for a specific billing period, MovingSteady will issue a refund for the affected period within a commercially reasonable time.
9. Promotional Items and Equipment
From time to time, MovingSteady may offer or provide optional exercise equipment or promotional items, such as a light resistance band. Any such item is intended only for use consistent with the accompanying instructions and is not medical equipment.
Users are responsible for inspecting equipment before use and discontinuing use if it appears damaged or unsafe. Users should follow all safety instructions provided with any equipment.
10. Intellectual Property and Permitted Use
The Service and its original videos, text, graphics, software, program design, and other content are owned by or licensed to MovingSteady and are protected by applicable intellectual-property laws.
Subject to these Terms, MovingSteady grants subscribers a limited, non-exclusive, non-transferable right to access the Service for personal, non-commercial use during an active subscription. Users may not reproduce, publicly display, resell, distribute, scrape, systematically download, or commercially exploit Service content without permission.
11. Prohibited Conduct
Users may not misuse the Service, attempt to gain unauthorized access to another account, interfere with the operation or security of the Service, share paid access for unauthorized commercial purposes, use the Service to violate law or another person’s rights, or attempt to reverse engineer or circumvent access controls except where such restriction is prohibited by law.
12. Communications
MovingSteady may send transactional communications related to accounts, billing, weekly workout availability, security, or material changes to the Service. Marketing communications, where used, will be handled in accordance with applicable law and available opt-out rights.
13. Privacy
MovingSteady may collect and use information as described in its Privacy Policy. Users should review the Privacy Policy for information about data collection, use, sharing, retention, and choices.
14. Third-Party Services
The Service may rely on third-party hosting, authentication, payment, analytics, email, video-streaming, and other technology providers. MovingSteady is not responsible for third-party services to the extent permitted by law, and use of some third-party functionality may be subject to separate terms or privacy practices.
15. Availability and Changes to the Service
MovingSteady may modify, update, suspend, or discontinue features of the Service. MovingSteady does not guarantee uninterrupted or error-free availability. If a paid Service is materially discontinued, MovingSteady will provide any remedy required by applicable law and may provide additional remedies in its discretion.
16. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. MovingSteady does not make warranties regarding specific health or fitness results, continuous availability, or suitability of the Service for a particular person or medical condition. Any warranties that cannot legally be excluded remain unaffected.
17. Limitation of Liability
MovingSteady and its owners, officers, employees, independent contractors, content reviewers, service providers, and agents (collectively, “Released Parties”) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Service.
18. Indemnification
You agree to indemnify, defend, and hold harmless MovingSteady and its owners, officers, employees, independent contractors, content reviewers, service providers, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
1. Your breach of this Agreement; 2. Your violation of any law or the rights of any third party; 3. Your negligent or intentional misconduct in connection with the Service; 4. provided, however, that this indemnification obligation shall not apply to the extent the claim arises from the negligence, gross negligence, or willful misconduct of MovingSteady.
Scope Limitation for Consumer Agreements. This indemnification provision shall be interpreted to the fullest extent permitted by applicable law. In consumer contracts, any indemnification obligation that would require a consumer to indemnify a business for the business’s own negligence or violations of law is against public policy and may be deemed unenforceable. If any portion of this provision is held unenforceable, it shall be severed, and the remaining provisions shall continue in effect.
19. Suspension or Termination
MovingSteady may suspend or terminate access for material violations of these Terms, fraudulent or unlawful activity, threats to security, or nonpayment. Where appropriate and legally required, MovingSteady may provide notice or an opportunity to cure before termination.
20. Changes to These Terms
MovingSteady may update these Terms from time to time. Material changes will be communicated in a manner appropriate to the change and applicable law. Changes will become effective on the stated effective date. Where affirmative consent is legally required, MovingSteady will request it.
21. Governing Law, Venue, Dispute Resolution, and Arbitration
This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles.
22. Severability and Entire Agreement
If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. These Terms, together with documents expressly incorporated into them, form the agreement governing use of the Service, subject to any rights that cannot be waived under applicable law.
